TRAVEL CONTRACT AND RESPONSABILITY
The
travel contracts effectuated will be regulated under the Law D.L. 111
dated 17/03/1995, put into effect by the Directive 90/314/CEE, according
to international travel conventions and in particular by the Convention of
Brussels dated 20/04/1970,
enforced by Law number 1084 dated
29/12/1977. The responsibility for the organization of the trip can
by no means exceed the limits provided for by the above-cited laws. 2.
BOOKINGS The
acceptance of bookings
by the agency is subject to the availability of places and is understood
to be finalized from the moment of the confirmation by the organizer.
In the agency-organized trips which include bus rides or bus tours,
the available seats are assigned according to the chronological order of
the receipt of the pertinent deposit.
This rule is not valid for daytrips.
3.
PAYMENT At
the moment of booking, a deposit of 25% of the total price must be sent
in.
In some cases, there is also a booking fee which amounts to
€10.00 for multi-day trips worth less than €500.00, and €20.00 for those
worth more than €500.00. The balance must be settled within 20 days
previous to the departure date. For
registrations effectuated within 30 days previous to the departure date,
the entire sum must be paid at the moment of booking. If the booking of an
NSOE trip takes place more than 31 days previous to the departure, there
is a discount of the booking fee. The
failure by the participant registered for a tour to respect these
conditions authorizes the agency to annul the booking even if it is
already confirmed. Registration implies full acceptance of all present
norms and conditions by the traveler. 4.
VARIATIONS IN THE PROGRAM Previous
to the departure, the agency has the right to significantly modify the
travel program, as provided in article 12 of Law
D.L. 111 dated 17/03/1995. After the departure, whenever an
essential part of the services agreed to in the contract cannot be
effectuated, the agency will provide appropriate alternative solutions
which enable the continuation of the journey. 5.
CANCELLATION OF TRAVEL BY THE
AGENCY The
agency reserves the right to annul a trip at any moment before departure,
in accordance with article 10 of Law n°1084 dated 27/12/1977, the
ratification and execution of the International Convention on Travel
Contracts (CCV) signed in Brussels on 23/04/1970. The responsibility of
the agency is limited to the sole restitution of the monies deposited. 6.
CANCELLATION OF THE BOOKING BY THE CUSTOMER The
customer who finds it impossible to make use of the booked travel package
may (except for those trips which include flights) yield his or her place
to another person who satisfies the required conditions for the journey.
However, this is only possible if the NSOE agency
is informed in writing.
The letter must arrive at least 4 working days previous to
departure. All pertinent personal data of the new traveler must be
included. Both customers are held responsible
for the payment of the balance of the price and for any further
expenses incurred by the agency which derive from this modification. 7.
WITHDRAWAL If
a participant registered for a trip should withdraw from the
contractual agreement for reasons other than
those specified in the cases addressed in articles 11 and 12 of Law
D.L. 111 dated 17/03/1995, he
or she has the right to a refund of a net sum arrived at by deducting from
the total price a penalty according to the following scale: (In
addition, the agency reserves the right to subtract any outstanding fees
or expenses related to the cancellation of their services.)

the
booking fee : from 30 to 21 days previous to the departure; -
30% of the total price : up to 20 days previous to the departure; -
50% of the total price : up to 7 days previous to departure; -
70% of the total price : up to 3 days previous to departure; -
the entire amount : after that time limit; or in the case of the customer
not showing up at the departure; or in the case of the customer
interrupting their participation in a trip which has already begun; or in
the case of someone who is not able to effectuate the trip for lack of, or
inaccuracy of, their personal identification documents such as a passport.
At the moment of the definitive confirmation of the trip, it is strongly
advised that the participant take out a special insurance policy which
covers the expenses related to a possible withdrawal from the contractual
agreement itself according to the general conditions of the insurance
company. 8. VALIDITY OF THE PRICES
The
prices are calculated on the basis of exchanges, the costs of carriers,
and the costs of the various services indicated in the travel program at
the moment it is issued. Therefore, the final price may vary as a
consequence of changes in the above-mentioned categories. If the overall
rise exceeds 10% of the total price, the customer has the right to
withdraw from the contractual agreement as long as this is communicated to
the agency in written form within 2 working days of receiving the
communication relative to the rise.
In the absence of this written communication by the customer, it
will be understood that the modification has been accepted. -
IDENTITY PAPERS OR DOCUMENTS – Valid
identity papers are necessary everywhere; in some countries it is required
to bring a passport which is valid for at least 6 months after the date of
entry.
